ASK Perks Loyalty Scheme – Terms and Conditions

 

  1. These terms and conditions apply to your membership of the ASK Perks loyalty scheme app which is operated by ASK Italian Restaurants Limited t/a ASK Italian (“we“, “us“, “our“). By downloading the ASK Perks loyalty scheme app onto your mobile device and/or creating an ASK Perks loyalty scheme app account, you agree to comply with these terms and conditions.

How the Loyalty Scheme Works

  1. Membership of ASK Perks loyalty scheme app gives you the chance to progress through tier levels by earning a stamp (“Stamp“) which is recorded on a digital stamp card on your account, each time you make a qualifying purchase when dining in at participating ASK Italian restaurants only. Details of the current participating restaurants and what is qualifying purchase, which may change periodically, is available here. Stamps may also be awarded on an ad hoc basis from time to time in our sole discretion.
  2. Digital stamp cards can only be accessed via the ASK Perks loyalty scheme app on your mobile device.
  3. Collection of Stamps will entitle you to access and progress through the tier levels of the ASK Perks loyalty scheme (starting at Level 1 and going through to Level 3). The different tier levels of ASK Perks loyalty scheme grant you access to:
    1. perks (“Perks“) which you can use once a day for as long as you are a member of ASK Perks loyalty scheme app (and which may be subject to an expiry date and other terms and conditions); and
    2. rewards (“Rewards“) which are benefits granted on a one-off basis when you join the relevant tier level (and which may be subject to an expiry date and other terms and conditions).
  4. Your current tier level (and Stamps needed to reach the next level) will be displayed in the ASK Perks loyalty scheme app alongside any available Perks and Rewards. Perks and Rewards are subject to availability and will change over time. Details of available current Perks and Rewards for each tier level can be found here. Individual terms and conditions may apply to each Perk and each Reward. On special occasions (for example, your birthday) we may also grant you additional Rewards or other benefits.
  5. Once you are a registered member of ASK Perks loyalty scheme app, provided that you check-in to your table via the app whilst dining at a participating restaurant and make a qualifying purchase, you will earn a Stamp, which will be automatically added to your digital stamp card. You can view and track your Stamps on the ASK Perks loyalty scheme Only one stamp can be earned per table.
  6. When you join ASK Perks loyalty scheme app you will start at the lowest membership level and can progress through the available membership levels depending on how many qualifying purchases you make (each qualifying purchase entitling you to a Stamp) in a 12 month period. Details of the levels, how the 12 month period is determined, the number of Stamps needed to reach the next level and how you can go up, down or stay at the same level are described in the app and in our FAQs which can be found here. The criteria for achieving levels and the Perks and Rewards available at each level may change periodically but you will always stay at any level you achieve for 12 months.

Eligibility

  1. Please note that Stamps will not be earned for the purchasing of gift vouchers whether issued by us or by any third party.
  2. In order to be eligible to join the ASK Perks loyalty scheme app, you need to be at least 16 years old and a resident in the United Kingdom.

Security and Privacy

  1. You are responsible for ensuring you keep your log-in details and password for your ASK Perks loyalty scheme app membership account secure and for all activity that occurs on your membership account. You should not permit anyone else to use your digital stamp card and/or membership account and you must contact us immediately if you suspect or become aware that a third party knows your log-in details and/or password or has accessed your membership account. We will take reasonable steps to keep your membership account secure and you must comply with any security requirements that we tell you but we will not be responsible for any loss of Stamps, Perks or Rewards, or misuse of your membership account if this is caused by you not doing so.
  2. There are no membership fees associated with the ASK Perks loyalty scheme but as part of signing up you will need to provide us with certain personal information, so please see our for further details about how we process your data. All your details must be kept up to date at all times.

Cancellation and Changes

  1. You may cancel your membership of the ASK Perks loyalty scheme app at any time by following the process set out in the app or by sending us a notice using our contact page We will cancel your membership account promptly after receiving such notice. Once your membership account is cancelled, you will lose access to your digital stamp card and all Stamps, Perks and/or Rewards that were applicable at the point of cancellation.
  2. We may cancel your membership account if you do not comply with these terms and conditions or if we reasonably suspect any fraud has taken place in relation your membership or your collection or redemption of any Stamps, Perks or Rewards. We will act reasonably in cancelling your membership account, but our decision to do so is final. Upon cancellation, you will lose all Stamps and access to any Perks and/or Rewards associated with the level you had attained at the point of cancellation.
  3. We may change or cease to operate the ASK Perks loyalty scheme, including by amending these terms and conditions or any individual membership, at any time. We will usually give you at least 30 days’ notice before we make any changes. We may send you the updated terms and conditions and updated terms and conditions will also be available on our website. It is your responsibility to ensure you are aware of the current terms and conditions. If you do not wish to agree to the changes in the terms and conditions for your ASK Perks loyalty scheme membership then you should cancel your membership account under clause 13. By continuing to use your ASK Perks loyalty scheme app after the changes take affect you are agreeing to those terms and conditions.

General

  1. Stamps, Perks and Rewards can only be earned, held and redeemed as set out in these terms and conditions (and the terms and conditions of the relevant Perks and/or Rewards). Any Stamps, Perks or Rewards acquired or used otherwise than in accordance with the relevant terms and conditions will be invalid and cannot be redeemed. Stamps, Perks and Rewards have no cash value and are personal to you. Neither your accumulated Stamps or your entitlement to any Perks and/or Rewards may be sold, transferred, assigned, or shared with anyone.
  2. Your account is intended for your personal use and is not intended for any business use. We are therefore not liable for any business losses that might arise including loss of profit. We do not seek to exclude or limit our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law. In all other cases, however, we do not accept liability for any damages, injury, costs or expenses suffered or incurred by you in relation your membership of the ASK Perks loyalty scheme app, or redemption or use of any Perks and/or Your statutory rights are not affected.
